The following are the terms and conditions on which Demcares offers you access to its website and services.

This Agreement describes the terms and conditions applicable to the site user and user of our services at Demcares. We may amend this Agreement at any time by posting the amended terms on our site. Except as stated below, all amended terms shall automatically be effective 30 days after they are initially posted on our site.
This is a binding agreement between Demcares and the user. This Agreement governs the use of the Demcares Website, including, without limitation, all content such as databases, text, information, images, and audio and all services made available to the users through the Demcares Web site by us and/or third parties.

Who can become a user?

Our services are available only to individuals (excluding minors) who can form legally binding contracts under applicable law. If you do not qualify, please do not use our services. Further, our services are not available to temporarily or indefinitely suspended DEMCARES users.

How one should use DEMCARES’s content

The content consists of copyrighted works proprietary to Demcares or to third parties who have provided us with content. You may download and print a single copy of the content solely for your use in connection with your internal non-commercial use. Any content you download or print may not be altered in any way and must contain all copyright and proprietary rights notices that were contained in such content. Any unauthorised or unapproved use of any of the content constitutes copyright infringement and subjects the user to all civil and criminal penalties provided for under domestic and international copyright laws and treaties.

Personal Information of user

Personal Information is defined as any information you provide to us. You are solely responsible for such personal information, and we act as a passive conduit for receiving and processing your requests based on your personal information.

With respect to Personal Information (or any items listed therein):

• Shall not be false, inaccurate or misleading.
• Shall not be fraudulent.
• Shall not infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy.
• Shall not violate any law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti discrimination or false advertising).
• Shall not be defamatory, unlawfully threatening or unlawfully harassing.
• Shall not contain any viruses, Trojan horses, worms, time bombs, cancel bots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
• Shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.

Limit of Liability & Exclusion of damages

Demcares will not be responsible or liable to any user of the website or its services for any direct, compensatory, indirect, incidental, consequential, special, exemplary or punitive damages for any reason such as use of content, services, errors, inaccuracies, omissions, defects, untimeliness, security breaches or any other causes. Our legal liability to any user of Demcares website & services under all conditions and circumstances and at all times will be limited to INR 1000 (Rupees One thousand only)

Indemnity

You agree to indemnify and hold us and our subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, expert fees? and other reasonable costs of litigation, made by any third party, arising from or incurred as a result of, or in any manner related to

• Your breach of the terms of this Agreement.
• Your unauthorized or unlawful use of the site.
• The unauthorized or unlawful use of the site by any other person using your identity.

Arbitration
Any controversy or claim arising out of or relating to this agreement or our services shall be settled by binding arbitration in accordance with the commercial arbitration rules applicable to Tamil Nadu. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted at Chennai, Tamil Nadu, India and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or Demcares may seek any interim or preliminary relief from a court of competent jurisdiction at Chennai, India necessary to protect the rights or property of you or Demcares pending the completion of arbitration.

General terms & conditions
We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.

APPOINTMENT, REGISTRATION, AND BILLING

• All services, including enquiries and consultations, are available only during the hospital’s working hours: 9:00 AM to 4:30 PM, Monday to Saturday.
• Visit the hospital or schedule appointments during these hours.

Registration

Personal details will be collected from clients for registration either through the online platform or in person. Once registration is completed, the client’s details, including contact information, will be shared with our psychologist to facilitate the gathering of patient history.
The psychologist will contact the client within 24 working hours to discuss the patient’s medical history. Following the completion of this initial consultation, an appointment with a psychiatrist will be scheduled based on the psychiatrist’s availability.

Privileges of use of your personal informatio

In order to enable DEMCARES to use the personal information you supply us with, so that we are not violating any rights you might have in that information, you agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub licensable (through multiple tiers) right to exercise the copyright and publicity rights (but no other rights) you have in personal information, in any media now known or not currently known, with respect to personal information. DEMCARES will only use personal information in accordance with our Privacy Policy.

Information Accuracy

The site & certain services will be accessible to users of the website as identified in the Registration Forms. All user information provided to us, including without limitation the information on the Registration Forms, must be current, accurate, and complete. If we at any time discover any error or omission in the information you provide to us, we may, at our option, terminate the right to access and use the site by any user. The user/user’s are responsible for the acts or omissions by the use of the site, and for any damages incurred by the user as a result thereof.

Business Relationship

You as the user and Demcares are independent contractors, and no agency, partnership, joint venture, employee-employer, franchisor-franchisee or other business relationship is intended or created by this Agreement.

Intellectual Property

Demcares owns all worldwide rights, titles and interests in and to the site. You may create a bookmark in your browser to the homepage of the site. Otherwise, you may not create a link to the site without our prior written approval. All rights not expressly granted in this Agreement are reserved to us. No other rights or licenses, whether express, implied, arising by estoppel, or otherwise are conveyed or intended by this Agreement. To facilitate your access to and use of our site or portions thereof, we may make certain software available to you. The terms of your use of such software will be stated separately in a license agreement that will be included with the software. You agree to only use such software in a manner permitted pursuant to such license agreements.

Damage to website content

You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained herein without our prior expressed written permission. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Demcares site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. Much of the information on our site is updated on a real time basis and is proprietary or is licensed to Demcares by our users or third parties. You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content from our website without the prior expressed written permission of Demcares or the appropriate third party.

Breach of agreement

Without limiting other remedies, we may immediately issue a warning, temporarily suspend, indefinitely suspend or terminate your membership/subscription and refuse to provide our services to you: (a) if you breach this Agreement or the documents it incorporates by reference; (b) if we are unable to verify or authenticate any information you provide to us; or (c) if we believe that your actions may cause legal liability for you, our users or us.

Termination of agreement

Your right to access and use the site immediately terminates without further notice upon your breach of this Agreement. We may terminate this Agreement and/or your right to use the site at any time, with or without cause. We reserve the right to discontinue or make changes to the site at any time.

Privacy of members

We at Demcares are dedicated to protecting the privacy of our users.

Warranty of services

We and our associates provide the Demcares website and services “AS IS” and without any warranty or condition, express, implied or statutory. We and our associates specifically disclaim any implied warranties of with respect to any product or service.

Admission

Note: DEMCARES does not provide emergency admissions. All admissions must be planned and confirmed during working hours.

Clients seeking admission to the facility should contact the secretary at 73585 88822 to inquire about bed availability. There is no advanced booking available; admission is confirmed only when payment is made in person.
At the time of admission, a total of Rs. 22,000will be collected, which includes:

• Rs. 2,000 as non-refundable admission charges
• Rs. 20,000 as a refundable deposit

The refundable deposit will be returned upon discharge, after adjusting the total outstanding balance.

Billing

The billing cycle operates on a fortnightly basis,1st to15th and  16th to 31’st of each month.

Billing charges are as follows:

• Dormitory (shared) room: Rs. 1,800 per day
• Private room: Rs. 3,000 per day

Hospitalization charges include:

• Psychiatrist consultation
• Nursing charges
• Food and stay
• Laundry

Additional services, such as:

• Medication charges
• Lab expenses and scans
• Consultations with other specialists
• Personal expenses

will be billed separately.

The soft copy of the invoice will be sent to the client via email. The original invoice can be collected in person at the facility.

Payment Terms
Payments for the admitted services are to be made within 10 days from the date of receiving the invoice. Accepted payment methods include:

• Cheque
• NEFT (Bank Transfer)
• Cash
• Card payment

NOTE: Any payment in debt will strictly not be entertained. If payments not made within the specified period will incur late payment fees, as per the hospital’s late payment policy.

NOTE: DEMCARES is not part of any insurance network, and direct insurance payments are not accepted.

Refund Policy

The Rs. 20,000 refundable deposit will be returned to the client upon discharge, subject to the deduction of any charges for services rendered during the stay.

Limitation of Liability

DEMCARES shall not be liable for unforeseen medical complications or adverse outcomes, provided reasonable care and skill were exercised. The hospital is not responsible for errors or negligence by third-party service providers, including diagnostic labs or external specialists. Force majeure events, such as natural disasters or government restrictions, are beyond the hospital’s control, and DEMCARES shall not be held liable for delays or interruptions caused by such events.

Accountability of Medical Professionals

All medical professionals at DEMCARES are accountable for providing services with reasonable care, skill, and professionalism in compliance with the Indian Medical Council (Professional Conduct, Etiquette, and Ethics) Regulations, 2002.

DEMCARES ensures that:

• All healthcare professionals are registered with their respective Board, the National Medical Council , National Commision For Allied and Healthcare Professional and Indian Nursing Council.
• Any instance of negligence or misconduct by all staff will be addressed promptly in accordance with hospital policies and applicable laws.

Clients may report concerns or grievances regarding medical care to the hospital management, who will investigate and respond appropriately.

Accountability of Clients

Clients are responsible for providing accurate and complete information during registration and treatment. Misrepresentation of facts or failure to disclose critical medical information will absolve DEMCARES of any resulting liability.Clients, patients, and visitors must adhere to hospital rules and maintain respectful behavior toward staff and other patients.

Privacy and Confidentiality

DEMCARES maintains strict privacy and confidentiality standards. All personal details, medical history, and patient information will be kept confidential in compliance with applicable data protection laws. Information will only be shared with relevant healthcare professionals involved in the patient’s treatment.

Rights and Responsibilities

By completing the registration and admission process, clients agree to comply with the policies outlined above. Clients are responsible for providing accurate information during registration and for making payments as required.
